Summary of Judgment in: SUIT NO: FHC/ABJ/CS/54/2012: ARCHIANGA & ORS v. NNPC & 2 ORS

 

The Law Firm of Paul Usoro and Co (PUC), today, 21 June 2021 successfully defended a Suit brought by HRH Obong Archianga and others against the Exxon Mobil Corporation in Suit No: FHC/ABJ/CS/54/2012 between Obong Archianga & Ors v. NNPC & 2 Ors. In upholding the Firm’s arguments on a Point of Law Motion filed by PUC and argued by the Lead Counsel to Exxon Mobil Corporation (EMC); Mr. Paul Usoro, SAN for and on behalf of EMC, the Court, per Taiwo Taiwo. J in its final Judgment agreed that the Suit did not disclose a Cause of Action against EMC as the Plaintiffs did not establish that Mobil Producing Nigeria Unlimited is a subsidiary of Exxon Mobil Corporation. The Court also agreed with the Firm’s contentions that the Plaintiffs’ case as it relates to EMC is speculative, conjectural and without any foundation or basis whatsoever. Incidentally, the other Respondents were found liable for pollution and damages to the Plaintiffs’ lands and chattel and were ordered to pay N81 Billion Naira. In essence, PUC’s Defence of EMC staved off that heavy penalty from the Court.
