In December 2008, PUC successfully prosecuted an Appeal in favour of the Securities and Exchange Commission (SEC). The Appeal was against the Judgment of the Federal High Court which held that the Plaintiff did not have fair hearing contrary to sections 36(1) & (9) of the 1999 Constitution of Nigeria in connection with an investigation conducted by the SEC Administrative Proceeding Committee. The lower court granted the Plaintiff’s prayer for an Order prohibiting the Administrative Proceeding Committee of the SEC from hearing any evidence, adjudicating and/or entertaining the application relating to Applicant for lack of fair hearing. The issue for determination on Appeal was whether SEC, the Appellant, through the Administrative Proceeding Committee, was in contravention of Section 36 or any other provision of the Constitution in the proceedings. The Court of Appeal, agreeing with our submissions, reversed the Judgment of the High Court that the Proceedings of Appellant’s Committee did not contravene the provisions of section 36 of the 1999 Constitution.
