This Appeal was an offshoot of the FHC/ABJ/550/03: Blue-Chip Communications Company V. Nigerian Communications Commission. Dissatisfied with the Ruling of the Federal High Court (“FHC”) striking out the Suit, the Appellant had approached the Court of Appeal for a reversal of the FHC’s decision. PUC successfully defended the Ruling of the FHC and the Court of Appeal in a unanimous decision dismissed the Appeal in its entirety.
